Ed Burke published in new Thomson/Reuters treatise on e-Discovery September, 2008 We are pleased to announce that Ed Burke, representing Bodhi Global, has a chapter in the new Thomson Reuters treatise e-Discovery for Corporate Counsel (Thomson Reuters 2008). Ed, our President and formerly a litigator with Weil Gotshal & Manges, co-authored the chapter titled "Off-shoring Litigation Document Review." Ed's section of the Chapter discusses the changing landscape that has led to the off-shoring of litigation document review and the growing importance of project management protocols in monitoring such projects. The trend to off-shoring litigation review projects was recently discussed by the ABA in its formal ethics opinion (http://www.abanet.org/abanet/media/release/news_release.cfm?releaseid=435). The ABA approved the practice and set forth the ethical factors that lawyers should consider when determining whether to send projects off-shore. In addition to discussing the factors that have led to off-shoring, the chapter describes how an off-shore project works in practice, including the use of project management tools like Six Sigma. In the end, off-shoring is not just a matter of cost savings. If done properly, it can add to the overall defensibility of the document review project. The second part of the chapter was written by Prashant Dubey, Senior Vice President of Fios, Inc. Dubey's section describes how the IT department has approached outsourcing decisions for over a decade and can impart that wisdom to the Legal department.
